These terms apply when you buy from or work with Harbourcut Studio ("Harbourcut", "we", "us") through harbourcut.com, our booking links, payment links, invoices, Gumroad or by email. They cover:

How these terms become part of your order. We'll link to these terms in your quote, order form, invoice or payment link. By paying a deposit, placing an order or confirming a quote in writing, you agree to them. If a written quote or order confirmation that we've signed or sent conflicts with these terms, the quote or confirmation wins for that order. Otherwise these terms apply.

Prices and taxes. Prices in USD. Taxes added where applicable.

Payment methods. Unless a section says otherwise, you can pay by card or e-Transfer (Stripe once live). e-Transfers go to [email protected]. We never ask for card numbers by email, phone or text.

A. Video ad services (Starter, Growth, Retainer)

A1. Payment. - One-time packages are paid 50% as a deposit to start and 50% on delivery. - Work is booked once the deposit is received. - Final, unwatermarked files are released once the balance is paid.

A2. First drafts. First drafts arrive within 3 business days (Starter) or 5 business days (Growth) after we receive both your deposit and your materials (photos, logo, offer details and answers to our brief). - Business days are Monday–Friday, excluding BC statutory holidays. - If your materials are late or incomplete, the clock starts when we have everything. We'll tell you what's missing.

A3. Revisions. - Each ad includes 2 revision rounds. Extra rounds are $55 each, and we'll confirm before starting one. - A revision round is one consolidated set of changes to an existing draft. - Each revision round is delivered within 2 business days of receiving your consolidated changes. - Growth: after you approve the vertical ads, the 1:1 and 16:9 reformats arrive within 3 business days. - A new concept, script or format is new work. We'll quote it in writing first, and we won't charge for it unless you agree.

A4. Deposits and cancellations. - Deposits are refundable until work starts. Work starts when we begin producing your drafts. We'll tell you in writing (email is fine) when that happens. - If you cancel before then, we refund the full deposit within 14 days, by the method you paid with. - Once work has started, the deposit is non-refundable, except where the law requires otherwise or we fail to deliver.

A5. Retainer. - The Retainer ($1,049/month) is billed monthly at the start of each month. - Ads are delivered in 2 batches, on the 1st and 15th of each month. Each batch's first drafts arrive within 5 business days of that date. - Either of us can cancel with 30 days' written notice (email is fine). There's no minimum term. - Fees for the notice period are payable, and we'll deliver the work for that period. Months already billed aren't refunded, except where the law requires it.

A6. Founding-client price. The founding-client price ($249 for the Starter package, for our first 3 clients) has no testimonial, review or referral condition.

B. Custom AI video commissions ($35 / $105 / $209)

B1. Payment. A 50% deposit to start, and 50% on delivery before we send the clean, full-resolution files.

B2. First drafts. - Quick and Standard: within 3 business days after the deposit is received and your order form is complete. - Premium: within 3 business days of storyboard sign-off. - First drafts are watermarked previews.

B3. Revisions. - Quick (US$35): 1 revision round, then US$15 per extra round. - Standard (US$105) and Premium (US$209): 2 revision rounds, then US$55 per extra round.

B4. Deposits. Deposits are refundable until work starts, and non-refundable after that, except where the law requires otherwise or we fail to deliver. Refunds are made within 14 days, by the method you paid with.

B5. Personal use. Commissions are licensed for personal, non-commercial use (see G3). Business or commercial use must be agreed and quoted in writing before you pay.

B6. Content rules. - We don't make realistic AI likenesses of real people, deepfakes, impersonations, celebrities, or copyrighted characters, logos or music. - We don't make hateful, sexual or political content. - We may decline or cancel any order that breaks these rules. If we cancel before work starts, we refund your full deposit. If we cancel after work starts because the request breaks these rules, we may keep the deposit.

C. Prompt packs (digital products)

C1. Purchase. - Prompt packs are sold in USD through Gumroad, which processes the payment and acts as the merchant of record. - Gumroad's own checkout terms also apply to the purchase.

C2. Refunds. 14-day money-back guarantee. Email [email protected] within 14 days of purchase for a full refund, no questions asked.

C3. Licence. - You may adapt the prompts for your own use (single buyer or business). - You may not resell, share, sublicense or redistribute the prompts, edited or not, including in other packs, courses, GPTs or marketplaces. - We keep all other rights in the prompts and guides.

C4. AI tools and outputs. - Usage rights for generated outputs depend on each AI tool's own terms. Check them before commercial use. - Results vary by model and settings. We don't promise any particular output. - AI outputs may not be protected by copyright everywhere, and others can generate similar outputs. - We're not affiliated with or endorsed by any AI model provider.

D. Partner (white-label) program

D1. Payment. Partner orders are 100% prepaid before work starts. This includes rush add-ons and extra revision rounds. The monthly pack ($349/month) is prepaid at the start of each monthly cycle. Prices: single spot $69, 5-hook pack $175, monthly pack $349/month, rush +$35.

D2. First drafts. - First drafts arrive within 72 hours of payment and a complete brief. - The rush add-on (+$35) gives a 24-hour first draft.

D3. Revisions. 1 revision round is included. Each extra round is $55, prepaid.

D4. Usage rights. - Usage rights pass to the partner and its client only with the final, watermark-free clips, after payment and approval. - Review drafts carry no usage rights.

D5. No exclusivity or IP indemnity. We don't offer exclusivity or IP indemnity for partner work. You're responsible for having the rights to everything you or your client send us (G2).

D6. Full partner terms. If we publish separate partner terms, they add detail to this section. If they conflict with it, the separate partner terms win for partner orders.

E. Referral program

E1. Reward. When a business you refer becomes a client and pays its first invoice in full, you choose 15% of that first invoice or a $35 credit. Cash rewards are paid by Interac e-Transfer. e-Transfers go to [email protected].

E2. Program rules. - You must be 18 or older. Self-referrals don't count. The referred business must be new to us and mention you before its first invoice. - Share your code only with people you know. No spam, bulk messages, coupon sites or bought lists. - If a referred client's first invoice is refunded, the reward for it isn't owed, and a reward already paid for it may be reversed. - We may change, pause or end the program by posting a notice. Rewards already earned before the change are still paid. - If we publish separate referral terms, they add detail to this section.

F. AI automations (receptionist, text-back, review/GBP manager, custom agents)

F1. Fees. - AI receptionist: $209 setup plus $69/month. - Missed-call text-back: $69/month. - Review & Google Business Profile manager: $105/month. - Custom AI agents: $350–1,050 one-time, on a fixed written quote agreed before work starts. - Monthly services are billed monthly at the start of each month. - Carrier, SMS and phone-number costs are agreed with you in writing before you commit. We won't add a cost you haven't approved.

F2. Setup fees and cancellation. - Setup fees are refundable until the build starts. We'll tell you in writing when it does. Refunds are made within 14 days. - Monthly services can be cancelled by either of us with 30 days' written notice (email is fine). There's no minimum term. Fees for the notice period are payable; months already billed aren't refunded, except where the law requires it. - For custom agents, the payment schedule is set out in the written quote.

F3. Go-live. Building usually takes about 5 business days after your intake form and phone-number setup. This is an estimate, not a guarantee.

F4. AI disclosure. Our AI assistants identify themselves as AI to callers and texters. You agree not to ask us to present them as human.

F5. Your information and your customers. - The assistant only uses the information you give us. You're responsible for keeping it accurate (hours, prices, services). - You confirm you're allowed to forward your calls and messages to our service. - You're responsible for your own legal obligations to your callers and customers, including your privacy notice and CASL consent for any messages you ask us to send. We'll handle your callers' information only to provide the service to you, keep it secure, and delete or return it when the service ends. Calls are recorded and transcribed, and we tell callers at the start of each call. We keep recordings, transcripts and text messages for 30 days. - Retention for your line. Calls are recorded and transcribed, and we tell callers at the start of each call. We keep recordings, transcripts and text messages for 30 days. Call logs for your line (number, time, duration, outcome) are kept for 24 months after you leave, then deleted.

F6. Reviews. - We never write fake or incentivized reviews. - Review replies are drafted for your approval. - Review requests go only to your real customers.

F7. Service availability. - Automations depend on third-party providers (telephony, voice, AI, calendar and hosting). - We'll take reasonable care to keep the service running and fix problems promptly, but we don't guarantee uninterrupted service. We aren't responsible for missed calls or messages caused by provider outages or events outside our reasonable control.

G. Terms for everything

G1. AI-assisted labelling. - Our ads and videos are made with AI tools and carry an AI-assisted (or "AI-made") label. - You agree not to remove or obscure it, and to turn on platform AI-content labels where a platform requires them (for example Meta, TikTok and YouTube).

G2. Materials you supply. - You confirm that you own, or have permission to use, everything you send us: photos, footage, logos, music, text and the likeness of anyone shown. - You confirm you have the consent of the people in your photos (or their parent or guardian). - You keep ownership of your materials. You give us a limited licence to use them only to make and deliver your work. - If someone makes a claim against us because of materials you supplied in breach of this section, you're responsible for the reasonable costs that result. This doesn't apply to claims caused by our own work or fault.

G3. Usage licence for finished work. - When you've paid in full, you get a perpetual, non-exclusive licence to use the final files for your own marketing. - For ad services and the partner program, the licence is for your own marketing (advertising and organic social media). - For commissions, it covers personal use unless commercial use was agreed in writing. - We keep ownership of our templates, prompts, methods, project files, and any stock, archive or AI-generated footage. We license the finished work to you; we don't assign copyright unless we agree to in writing. - AI-generated material may not be protected by copyright in every country, so we can't promise you exclusive legal rights in it. - Unpaid or watermarked drafts carry no licence.

G4. Archive footage is non-exclusive. - The archive and AI-generated footage in your work is non-exclusive, and the same or similar clips may appear in work for others. - We don't promise exclusivity. We won't reuse your own brand assets or footage for anyone else.

G5. Portfolio. We won't show your work in our portfolio, or name you as a client, without your written permission.

G6. No guaranteed results. - We design ads and hooks to improve the odds, but we don't guarantee views, leads, bookings or sales. - We make no health-outcome or income claims.

G7. Content we won't make. - We don't make political ads, adult content, deceptive content, fake reviews or testimonials, or real-person likenesses or voice clones. - We don't make content using third-party brands without permission. - We may decline any project before we accept it. If we decline after taking a deposit, we refund it in full.

G8. Limitation of liability. - We'll do the work with reasonable care and skill. If we don't, tell us and we'll fix it first; if we can't, we'll refund what you paid for the affected work. - To the extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid us for that order. For monthly services, it's limited to the fees you paid in the 3 months before the claim. - To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, such as lost profits, lost revenue or ad spend. - Nothing in these terms limits or excludes liability that can't legally be limited, including for fraud, or your rights under consumer protection law, including British Columbia's Business Practices and Consumer Protection Act.

G9. Warranties. - We promise only what these terms and your written quote say. To the extent the law allows, we don't give any other warranties, express or implied. - We don't warrant that AI-generated material doesn't infringe anyone's rights, but we won't knowingly use material that does, and we'll replace any element you show us is a problem. - Any warranty or condition that the law says can't be excluded still applies.

G10. Payments and late payment. - Payments are made by card or e-Transfer (Stripe once live). e-Transfers go to [email protected]. We never ask for card numbers by email, phone or text. - If an amount is overdue, we may pause work or hold files until it's paid. We'll tell you in writing first. We don't charge interest on late payments.

G11. Privacy. How we handle personal information is explained in our Privacy Policy.

G12. Changes to these terms. - We may update these terms by posting a new version on this page with a new "Last updated" date. - Orders already placed stay under the terms in force when they were placed. Ongoing monthly services move to new terms only after 30 days' notice, and you can cancel before then.

G13. Governing law. - These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. - The courts of British Columbia (Vancouver registry) have jurisdiction, except where consumer protection law gives you the right to bring a claim elsewhere. Before going to court, we'll both try in good faith to resolve the issue by email first.

G14. General. - If any part of these terms is found unenforceable, the rest still applies. - Failing to enforce a term isn't a waiver. - You may not assign these terms without our written consent. We may assign them only to someone who takes over our business and agrees to honour them.
